1. Acceptance of Terms

By creating an account or using VividHR, you agree to these Terms of Service and all applicable South African laws, including the Labour Relations Act (LRA), the Basic Conditions of Employment Act (BCEA), the Employment Equity Act (EEA), and the Protection of Personal Information Act (POPIA). These terms apply to all users including free trial and paid account holders.

2. Data & Privacy (POPIA)

All personal information collected — including candidate names, contact details, CVs, and video recordings — is processed in accordance with POPIA. Data is stored securely and is not sold to third parties.

You are responsible for obtaining appropriate consent from candidates before uploading their personal information to the platform. Candidate data may be retained for up to 24 months unless you request earlier deletion.

3. Credits & Billing

Credits are consumed when you use AI-powered features including video analysis (Video Pre-screen), CV matching (CV Match), and assistant messages (HR Assistant). Credits purchased are non-refundable except as required by the Consumer Protection Act (CPA).

Trial credits expire 30 days after account creation and are non-transferable.

4. Acceptable Use

You may not use VividHR to discriminate unfairly against candidates on grounds prohibited by the EEA or any applicable legislation. AI-generated assessments must be used as one input among many in hiring decisions, not as the sole basis for rejection.

You are solely responsible for all hiring decisions made using or informed by the platform.

5. AI Policy

VividHR uses artificial intelligence to assist with recruitment activities. By using the platform, you acknowledge and agree to the following:

5.1 AI as a Decision Support Tool

AI-generated scores, rankings, assessments, and answers (including VIVID-FIT™ scores, CV match scores, and HR Assistant responses) are decision-support tools only. They are not binding determinations and do not replace the professional judgment of a qualified human recruiter or HR practitioner. All final hiring, shortlisting, and employment decisions remain the sole responsibility of the account holder.

5.2 Bias & Fairness

While we design our AI systems to minimise bias, no AI system is entirely free from bias. AI assessments may reflect patterns in training data that could inadvertently favour or disadvantage certain groups. You are responsible for reviewing AI outputs critically and ensuring your hiring process complies with the Employment Equity Act and all applicable anti-discrimination legislation. We strongly recommend that AI assessments are reviewed in conjunction with human evaluation.

5.3 AI Model Providers

VividHR uses third-party AI models (including Anthropic Claude) to process content. Candidate data submitted for analysis (including video transcripts and CV text) may be processed by these providers under their respective data processing agreements. No candidate data is used to train AI models without explicit consent.

5.4 HR Assistant Accuracy

HR Assistant provides information about South African labour law and HR practices. While answers are grounded in legislation and cite sources, they may contain errors or become outdated as laws change. HR Assistant responses do not constitute legal advice. For matters with legal consequences, you should consult a qualified labour law practitioner or attorney.

5.5 Human Oversight

You agree to maintain meaningful human oversight of all AI-assisted processes on the platform. You will not use automated AI outputs as the sole basis for any decision that materially affects a person's employment prospects without human review.

6. Intellectual Property

All platform software, AI models, scoring algorithms, and content created by VividHR remain our intellectual property. You retain ownership of data you upload but grant us a limited licence to process it for the purpose of providing the service.

7. Limitation of Liability

VividHR is not liable for hiring outcomes, employment disputes, or decisions made on the basis of AI-generated content. Our liability is limited to the value of credits consumed in the relevant transaction, to the extent permitted by South African law.

8. Governing Law

These terms are governed by the laws of the Republic of South Africa. Any disputes will be subject to the jurisdiction of the South African courts.
